The regulations governing lockdown levels 3 and 4 have been declared invalid and unconstitutional.
But the Pretoria High Court says they’ll remain in place, as is, for the next two weeks.
Judge Norman Davis made the ruling on Tuesday afternoon in a case brought by a group called Liberty Fighters.
The judge labelled several parts of the regulations irrational, including limiting exercise times, prohibiting informal trade, and closing parks and beaches.
However, his judgment says that some provisions are rational – and that having no regulations might lead to unmitigated disaster.
Judge Davis he’s given Minister Nkosazana Dlamini-Zuma 14 days to redraft regulations consistent with the Bill of Rights.
