Alleged underworld leader, Nafiz Modack and his co-accused, will find out on Monday, whether the charges against them will be dropped.
Modack and his 14 co-accused have brought an application calling for the string of charges they face, to be withdrawn.
These charges include the murder of detective Charl Kinnear, attempted murder, racketeering and money laundering, to name a few
Arthur Pose reports…
The accused are facing more than 100 charges in a trial centered around Kinnear’s murder.
The anti-gang unit detective was gunned down outside his Bishop Lavis house in September 2020.
Modack and some of his co-accused are being tried for Kinnear’s murder.
But they’ve denied any wrongdoing.
Accused number 2, Zane Killian, was the first person to be arrested for the crime.
He allegedly pinged Kinnear’s cellphone over a period of time.
Another accused is suspended police officer, Ashley Tabisher, who according to reports allegedly took money and a phone, supposedly funded by Modack.
The defence’s main argument has centered around the credibility of the state’s witnesses.
Some of these witnesses apparently have ties to Modack and some of his co-accused.
But the State has rejected these claims, arguing that the testimonies were credible.
Judge Robert Henney will have to decide if any of the charges will be withdrawn.
He will deliver his judgement on Monday.
