Western Cape Local Government and Environmental Affairs MEC, Anton Bredell, has lodged an appeal against the decision to halt construction of the River Club Development.
Bredell says his decision follows a number of errors in the Western Cape High Court’s judgement and interdict order delivered in March 2022.
He believes it is filled with misunderstandings on the public participation process.
The MEC also says Deputy Judge President Patricia Goliath ruled on matters that were not initially raised by the applicants.
Bredell adds that he’s concerned about the impact that this, and similar interdicts, may have on the province as an investment destination.
“We’re confident that public participation process complied with all stipulated requirements. We also argue that the Judge should have applied her mind to the balance of convenience or the various of trade-offs for different parties when she made her judgment”.
