
Alleged Parliament arsonist, Zandile Mafe, will remain at Pollsmoor Prison’s hospital section, as authorities search for bed for him at a psychiatric hospital.
On Monday, the Western Cape High Court ruled that he’s unfit to stand trial.
A psychiatric report submitted to court found Mafe suffers from schizophrenia.
Throughout the trial, Mafe insisted that he is ready to proceed with court proceedings.
But the court disagrees.
The inquiry into his fitness to stand trial was held under Section 77 of the Criminal Procedure Act.
The Act guides the court in how it must deal with an accused – who is not fit to stand trial, as a result of mental issues.
Once a placement has been confirmed, he will be referred to a psychiatric hospital to be rehabilitated.
The court acknowledged that Mafe does not want to be sent to the Valkenberg Psychiatric Hospital.
And has not ruled out the possibility that he could be sent to a facility in the North West, where his family lives.
His lawyer advocate Dali Mpofu indicated they will appeal Monday ‘s verdict.
