Afriforum is advising the energy regulator, the National Energy Regulator of South Africa (Nersa), to petition the Supreme Court of Appeal, to challenge the order against the implementation of unlawful charges for electricity.

The Gauteng High Court dismissed the Nersa’s leave to appeal last week.

Now, the national energy regulator says it’s evaluating its legal options, before taking the next step.

Afriforum had challenged Nersa’s decision, to allow some municipalities to implement new tariffs in July.

Last week, the court ruled that only municipalities that have submitted the required cost studies can implement their new prices.

Afriforum’s Morné Mostert says Nersa must not waste time and money on the courts.


He appeals to Nersa to stick to its mandate, which is to protect consumers.
